These Terms of Service (the “Terms”) apply to the use of the website operated by Catherine Galway Boutique (“we”, “our”, “the Company”). By visiting our Site and/or purchasing products from us, you agree to engage in our “Service” and be bound by these Terms, including any additional terms, policies, or notices referenced or accessible via hyperlink.

ARTICLE 3 – SCOPE OF APPLICATION

These Terms apply to any offer and distance contract concluded between Catherine Galway Boutique and the Consumer.

The Terms will be made available prior to contract finalization. If this is not reasonably possible, the Consumer will be informed where they can be accessed.

If product-specific terms apply, they supplement these Terms.
In case of conflict, the provision most favorable to the Consumer shall prevail.

If any clause is deemed invalid, the remainder of the contract stays in force.

ARTICLE 4 – THE OFFER

If an offer has limited duration or specific conditions, it will be clearly stated.

Descriptions must be accurate and complete. Images are representative, though color variations may occur. Obvious errors do not bind Catherine Galway Boutique.

Offers include:

Price (excluding import taxes and customs duties)
Any potential shipping fees
Required steps to conclude the contract
Withdrawal rights
Payment, delivery, and performance terms
Acceptance duration and conditions
Whether contract details can be stored
Available languages

ARTICLE 5 – THE CONTRACT

The contract is formed when the Consumer accepts the offer and fulfills the stated conditions.

In the case of electronic acceptance, Catherine Galway Boutique will immediately confirm receipt.

We secure electronic transactions with appropriate technology.

We reserve the right to verify solvency and may refuse an order if justified.

Upon delivery, the Consumer receives:

Complaint submission information
Withdrawal terms
Warranty and after-sales details
Any applicable termination conditions

ARTICLE 6 – RIGHT OF WITHDRAWAL

The Consumer may cancel their purchase within 14 days after receiving the product.

Items must be handled carefully and only to determine their nature and characteristics.
In the event of withdrawal, products must be returned in original condition and packaging.

The Consumer must notify Catherine Galway Boutique by email within 14 days, and return the product within 7 days after notification.

Failure to notify and/or return within the required timeframes voids the Right of Withdrawal.

ARTICLE 7 – COSTS IN CASE OF WITHDRAWAL

Return shipping costs are borne by the Consumer.

Catherine Galway Boutique will refund payments within 14 days following the withdrawal, subject to receipt of the items or proof of return.

ARTICLE 8 – EXCLUSIONS TO THE RIGHT OF WITHDRAWAL

The Right of Withdrawal is not applicable to:

Customized or made-to-order items
Perishable products
Sealed products that cannot be returned for hygiene reasons once opened
Services involving a specific execution date (events, travel, etc.)
During sale periods: orders above €100 are non-refundable. A store credit will be issued instead.

ARTICLE 9 – PRICING

Prices may vary due to VAT application or market conditions.

All prices are subject to typographical errors.
Catherine Galway Boutique is not obligated to deliver a product advertised at an incorrect price.

ARTICLE 10 – CONFORMITY & WARRANTY

Products must conform to the contract, normal usage expectations, and legal standards.

Warranty claims must be reported within 14 days after delivery.

Warranty excludes misuse, unauthorized repairs, and failure to follow product instructions.

ARTICLE 11 – DELIVERY & EXECUTION

Orders are processed as soon as possible and no later than 30 days unless otherwise agreed.

Any delay or partial execution will be communicated within 30 days.

The Consumer may cancel the contract and request a refund if necessary.

Risk transfers to the Consumer at the moment of delivery, unless otherwise stipulated.

ARTICLE 13 – PAYMENT

Payment must be completed within 7 days unless stated otherwise.

Any mistakes in payment details must be reported immediately.

Failure to pay may result in collection procedures.

ARTICLE 14 – COMPLAINTS

Complaints must be reported within 7 days after discovering the issue.

We will respond within 14 days and indicate a resolution timeline if required.

Unresolved complaints may become formal disputes.

ARTICLE 15 – GOVERNING LAW

Contracts and transactions are governed exclusively by the laws applicable in our operating jurisdiction.
